As an example of our trust in you, and your trust in us, we will keep your credit card of your choice on file.  Then if you don’t have cash, your card will available, and in the unfortunate case of a no-show, we also are protected.

 DESCRIPTION OF MEMBERSHIP   Members pays in full for one year.  This will allow Member to be picked up anywhere for one year.  The member will have called in and given dispatcher their destination.   At the time of pickup, they will pay the driver necessary fee.  If the Member wants his/her car driven home then an additional $25 will be charged to the member.  QPCS will then provide one vehicle and two licensed, insured drivers, to pick up Member, or members at specified location. Driver 1 will drive Member and guests to their desired locations. In members vehicle.   Driver 2 will follow in Q owned vehicle.  The driver will be paid in full at the time of pickup, or they may be charged to Members account on approved credit. At member’s final destination, Driver 1 will park car at Members request and Driver 2 will pick up Driver 1 and return to QPCS.

MEMBERS RIGHTS, WARRANTIES AND REPRESENTATIONS.   Member represents and is held in agreement as follows:

v  Member or members own or rent vehicle that is listed in

v  Driver from QPCS is given permission to driver Member’s vehicle set forth in this agreement

v  The vehicle will be in good repair and have sufficient fuel for journey.

v  Member will incur all expenses required to get vehicle to final destination. They will include but      not limited to extra fuel, towing, parking and roadside emergency.

v  Member will pay $20 cancelation fee for failure to show at pickup. An additional $10 every 15 minutes will be added following if driver or the Q is aware of late arrival.  Otherwise drivers will leave and account will be charged.

v  Members and guests will obey all laws of New Mexico including but not limited to: open containers, illicit drugs, stolen goods, violence towards driver or others in vehicle and weapons.

EMERGENCIES AND EMERGENCY CONTACTS- Member will provide a contact number and medical restrictions on need basis In the event an emergency takes place member authorizes QPCS to attempt to contact, and seek emergency care at a facility nearest the location of drivers and vehicle.

RIGHT FOR SERVICE REFUSAL AND BOOKING AVAILABILITY- The Q and its drivers will refuse service in the event patron is excessively intoxicated, armed, and belligerent, the vehicle is not safe for the road or events the driver would find unsafe or fit to drive in.  The availability is subject to first come, first served and appointments are preferred, especially on Fridays or Saturdays.  We can accommodate up to 39 people, and can reserve our passenger vans with a credit card in advance.

RELEASE OF LIABILITY- Member hereby:

a)       Releases QPCS, its management, employees and Drivers and/or any persons acting on its behalf, from any and all LIABILITY, including negligence for any injury, including death or property damage that may occur in connection with the service provided

b)       Agrees not to initiate any legal proceedings against QPCS, its management, employees and drivers or any person acting on its behalf with any such claims for damages, which member is releasing.

c)       Is aware that various risks are involved in providing the service, including the travel risks associated with riding in a vehicle, giving control of a vehicle to another person and the unknown actions of other drivers and their vehicles.

d)       Wants this service and is willing to agree to personally bear such risks assuming full responsibility for any harm or damage that may result.

DAMAGE LIMITATIONS- Without limiting the preceding release of liability above, QPCS and its Drivers’ liability for failure to perform under this agreement, for injury or damage, will be limited to $500 dollars. In no event shall QPCS or its Drivers be liable for any special, consequential, exemplary or punitive damages.

IDEMNIFICATION- Member shall indemnify, defend and hold QPCS, its management, employees, drivers and any person acting on its behalf harmless from and against any and all losses, liabilities, damages, fines, penalties and expenses (including attorneys’ fees) arising from or resulting from any breach of the representations, warranties or covenants contained in this agreement.

ACCEPTANCE- QPCS will be deemed to have accepted this Agreement, without execution, upon the acceptance of payment of membership fees. The parties acknowledge and confirm that they have participated jointly in the review of this Agreement

THIRD PARTY BENEFICIARY- Each driver is hereby designated as a third-party beneficiary of this agreement.

BINDING WAIVER- member fully intends and understands that the waiver of liability and hold harmless provisions of this Agreement shall be binding upon Member’s family, heirs, assigns, and/or personal representatives.

SOPHISTICATION OF PARTIES- Each party to this agreement represents that it is a sophisticated party capable of understanding all of the terms of this agreement, that it has hadean opportunity to review this agreement, and that it enters this agreement with full knowledge of the terms of the agreement. Member acknowledges and agrees that at the time Service is requested, Member may be intoxicated. Accordingly, Member hereby affirms that this Agreement, and the waivers and releases that are contained herein, are binding on the Member and will continue to be binding, notwithstanding the fact that Member may be intoxicated at the time he or she requests the Service.

MISCELLANEOUS- This Agreement constitutes the entire understanding of the parties with respect to the subject matter here of, and all prior and contemporaneous representations, negotiations and agreements between the parties are superseded and replaced hereby. There are no oral or written representations, agreements understandings or circumstances which modify any of the provisions hereof.  This Agreement shall be governed by the laws of the State of New Mexico, County of Bernalillo, and City of Albuquerque without regard to the conflict of law’s provisions thereof, and may be amended only in a writing signed by both parties.  No rights of any party hereunder may be waived except by a writing signed by the party to be charged with such waiver. If any provision of this Agreement is determined to be illegal or unenforceable by an arbitrator or a court of competent jurisdiction, this Agreement shall remain valid as though such provision had not been contained herein.
